Senate of Pennsylvania
Session of 2013 - 2014 Regular Session

MEMORANDUM

Posted: December 18, 2012 01:47 PM
From: Senator Richard A Kasunic
To: All Senate members
Subject: Adverse Possession Legislation

In the near future, I plan to re-introduce SB 1422 of last session, which will serve to abrogate the common law doctrines of adverse possession and easement by prescription in Pennsylvania. The bill will also make related repeals and will not apply to actions commenced prior to the effective date of the act.

The bill would effectively eliminate the taking of title to another individual’s property through the doctrine of adverse possession.

Previous co-sponsors of the legislation included: FARNESE, FONTANA, GREENLEAF, McILHINNEY and SOLOBAY.

If you have additional questions about this legislation, please contact my office at 717-787-7175.

Introduced as SB511
