Subject:	LEGISLATION~ PROCEDURE CHANGES FOR DISBURSEMENT OF MONEY TO INSTITUTIONS OF HIGHER EDUCATION BY THE STATE TREASURY

In the near future I plan to introduce legislation that will Amend the act of April 9 1929 (P.L.343, No.176) known as The Fiscal Code, in procedure for disbursement of money from the State Treasury, providing for withholding payments to certain institutions of higher education. This legislation notwithstanding any other provision of law to the contrary, the State Treasurer may not issue a warrant for payment to an institution of higher education for which the State Treasurer has received a determination from the Secretary of Education due to a person who believes that an institution of higher education is hindering the person’s exercise rights guaranteed by the First Amendment to the United States Constitution, may file a written complaint with the Secretary of Education, upon which the Secretary of Education shall investigate the complaint. This investigation will allow the institution of higher education with an opportunity to respond to said complaint, determine whether the institution of higher education is hindering the person’s exercise of rights guaranteed by the First Amendment to the United States Constitution and if so, the Secretary of Education shall submit a certified copy of its determination to the State Treasurer. If and when the Secretary of Education upon further investigation, becomes satisfied that the institution of higher education no longer hinders the exercise of rights guaranteed by the First Amendment to the United States Constitution, the Secretary of Education shall provide written notification to both the institution of higher education and State Treasurer allowing future disbursements of money.
