Subject: Legislation to Create the Offense of Occupational Intimidation
 
In the near future, I will introduce a bill to create the offense of Occupational Intimidation.

The offense is committed if a person, with malicious intention toward a law enforcement official, a firefighter, an emergency services provider or an employee or agent of a county children and youth social services agency, based upon the occupation of the individual, commits any number of offenses found in the Crimes Code, including terroristic threats, harassment, stalking, and assault, among others. The offense is modeled after the ethnic intimidation statute, having the same offenses as the underlying offense. In addition, the grading is the same as the offense of Ethnic Intimidation. The offense will be classified as a misdemeanor of the third degree if the underlying offense is a summary offense. Otherwise, the offense is graded one degree higher than the underlying offense. The definition of “malicious intention” also borrows the definition found in the ethnic intimidation statute.
