Subject: Allowing Former Judges and Mayors in Good Standing to Solemnize Marriages
 
In the near future, I plan to reintroduce HB 308 PN1829 from last session. This bill will allow for all former judges in good standing, elected or appointed, regardless of length of service, to solemnize marriages. Under current law, only elected former judges or those whose appointment aggregate service exceeds a full term of office (10 years for common pleas and above, 6 years for minor judiciary) may solemnize marriages. This seems to be an unnecessary distinction.

Moreover, the bill will permit a retired mayor who was elected but who has not served a full term in office to preform a marriage ceremony. This legislation merely amends Section 1503(a)(2) and (5.1) of Title 23 by striking language which required a former or retired justice, judge, magisterial district judge or former mayor to have served a full term in office in order to perform a marriage ceremony. This bill passed the House 189-0 last session.
