MEMORANDUM

Posted: February 7, 2017 04:14 PM
From: Representative Sheryl M. Delozier
To: All House members
Subject: Legislation to amend the public works contracting provisions of Title 62 PACS (former HB 125)

In the near future I will be reintroducing legislation (former HB 125) that will prohibit a government agency that intends to enter into a public works contract from preparing contract specifications that are exclusionary or discriminatory, to the extent that they either specify a particular brand name or otherwise limit consideration of other brand names. My proposal will amend the public works contracting provisions of Title 62 PACS.

The Commonwealth and its political subdivisions benefit when there is greater interest in and competition for public works contracts. In turn, there may also be a benefit for taxpayers, in that competition may produce cost savings. I believe that my proposal will facilitate greater competition by enabling more potential vendors to be responsive to public works contract solicitations.

Introduced as HB1582
