| Subject: | Notice of Unperformed Vehicle Recall Work |
| In the near future, I will be reintroducing House Bill 690 from the 2015-16 session as part of a package of vehicle consumer protection bills with Rep. Madeline Dean. This legislation would require car dealerships who sell used cars to disclose unperformed manufacturer recall work before selling a used car. This is an effort to avoid tragedy when a consumer purchases a car with serious known defects. Presently, there is no standard for sale of used vehicles or any manufacturer recalls. Dealerships, either knowingly or unknowingly, are putting vehicles up for sale with outstanding recall work. This can have deadly results. Under my legislation, automobile dealers will be required to determine from the vehicle's manufacturer whether or not any unperformed manufacturer recalls exist on the vehicle. If so, the dealer would be required to disclose to the purchaser in writing, prior to sale, details of those recalls. If the vehicle has outstanding recalls for which the manufacturer will reimburse the dealer, the dealer must perform or enable to be performed the work not later than 20 days after the sale to the buyer.
