Subject: Resolution - "Amending the Expulsion Process of a Convicted State Legislator"
 

In the near future, I will introduce legislation to amend the House Rules to require the expulsion process of a state legislator to be implemented at the time of conviction, not sentencing. This would result in a more expedient expulsion of a legislator who has been convicted of a crime which would make them ineligible to serve.

Under the current House Rules, if a legislator pleads guilty to a felony but sentencing occurs several months later, the Parliamentarian is not permitted to prepare a Resolution of Expulsion. This process currently cannot be started until after sentencing. Under my proposed legislation, the phrase "and upon imposition of sentence" would be removed from Rule 47. This would result in a more expedient expulsion near the time of conviction rather than having a convicted felon serving for several months during the time between a felony conviction and sentencing.
