MEMORANDUM

Posted: May 19, 2016 10:05 AM
From: Representative Gerald J. Mullery
To: All House members
Subject: Legislation Regarding Hunting Without a License.

In the near future I will introduce legislation that corrects a problem within Title 34 (Game) regarding hunting without a license.

Presently the code treats hunting without buying a license and hunting but forgetting to bring your license as the same. To me, the hunter who purchased a license and simply forgot to bring it when going on their hunt is much different than the person who did not buy any license and goes into the woods to hunt illegally.

Currently both offenses are classified as a Summary 3 in Section 2711 and carry a penalty of a fine of no less than $250 and no more than $500.

My bill will let stand the Summary 3 penalty for hunting without first buying a license. My language will lower the penalty for the hunter who is stopped in the woods without having possession of their legally purchased license to a Summary 7 with a penalty of a fine of $50.

Introduced as HB2110
