Subject: Possessory Lien for Towing and Storage
 
I will be introducing legislation that would amend Title 75 (Vehicles) to authorize police officers or other authorized government agencies to remove vehicles that are abandoned, unattended, wrecked, or obstructing traffic and transport to a storage facility for safe keeping.

My bill will prioritize a possessory lien for services lawfully provided in the conformity with the law and requires towing companies to provide timely notification to the registered owner. The prioritization of the possessory lien gives first position to towing companies for the purpose of recouping costs for vehicular towing and storage. Providing a statutory mechanism so that these small towing businesses are first in line for payment for delivered services will reduce business risk to these companies. Reducing unfair business risk to small companies is in the best interest of the state.

I believe this bill also provides consumer protections for individuals against unfair or deceptive towing practices, including excessive charges for towing and storage services, and an improved notification requirement and possession hearing procedure.
