Subject: Legislation Amending the Landlord Tenant Act
 
We plan to introduce legislation that would amend the Landlord Tenant Act in a manner that would make it less burdensome for landlords to evict tenants who discharge firearms within the confines of an occupied structure.

There is nothing in the Landlord Tenant Act that would allow a landlord to readily evict a tenant who unlawfully discharges a firearm from any location within an apartment, single-family dwelling or other such leased premises. Consequently, landlords have little recourse in evicting such an offending tenant.

Our legislation would make the unlawful discharge of a firearm from any location within an occupied structure a breach of the conditions of a lease and grounds for the landlord to evict the tenant. The legislation would define “occupied structure” to include any portion of an apartment, multiple dwelling premises, tenement building, single-family dwelling or other such leased premises.

It is imperative that we, as Legislators, do all we can to assure that our constituents feel safe and secure in their homes and communities; that is of primary importance. Therefore, we thank you in advance for joining us as a sponsor of this legislation.
