Subject: Extended Use Liquor Permits
 
In the near future, I plan to introduce a package containing two bills that will give municipalities the authority to give hotel, restaurant and club liquor licensees the option to apply for extended use permits so that they may sell liquor and malt or brewed beverages up until 4 a.m. on any given day. Extended use permits are vital to economic development and will help to attract more consumers, including our younger and talented millennial generation. My legislation does not divest the Liquor Control Board (LCB) of any of its duties, but rather brings local municipalities to the decision-making table where they will have a voice concerning the businesses located within their jurisdictions. I ask that you please join me in co-sponsoring this legislation.

Introduced as HB2225

Description:
The first bill would amend the Liquor Code to grant municipalities the authority to issue extended use permits to liquor licensees.  Under current law, the following restrictions apply to the sale of liquor and malt or brewed beverages:
  • Hotel and restaurant liquor licensees may not sell liquor or malt or brewed beverages from 2 a.m. to 7 a.m. on any given day with the exception of Sunday, whereby, liquor sales are not permitted after 2 a.m. 
  • Club licensees may not sell liquor or malt or brewed beverages from 3 a.m. to 7 a.m. on any given day. 
Before taking any applications for extended use permits under advisement, the municipal governing body would be required to hold a public hearing to gather information to determine whether the extended use permit would adversely affect the welfare, health, peace and morals of the municipality or its residents.
