Subject: | Repeal 1943 Act authorizing the Commonwealth and Municipalities to take over public roads and highways constructed by Federal government. |
In the near future, I will introduce legislation which repeals an archaic law from May 21, 1943 (former HB 2370 of 2013-2014). The current law allows the Department of Highways or municipalities to adopt existing highways built by the federal government. The law requires adherence to the Public Utility Law for any public utility facilities located along the road, which promotes the prevention of accidents and public safety. Once ownership is transferred, however, the Department of Highways is required to maintain the same width of the road as maintained by the federal government. This legislation would repeal this entire provision of the law because the law was enacted when the federal government constructed highways as an exercise of its war power. The current law is archaic because the federal government no longer builds World War II roads. Thank you for your consideration. |
