Dear Colleagues, Formulation, adoption and promulgation of rules and regulations concerning environmental protection is solely the responsibility of the Environmental Quality Board (EQB) by statute. Despite this significant responsibility, the EQB has no actual staff. Instead it is an amalgam of representatives of a variety of cabinet posts, boards, commissions and legislative appointments. Consequently, the EQB does not have legal counsel that is free of a structural conflict of interest. In the near future, I will introduce legislation to establish legal counsel for the EQB and its members that is free of conflicts of interest. This nonpartisan proposal is modeled on SB 307 introduced once again this session by Senator Yudichak. John A.
