Subject: Direct Shipment of Wine
 
In the near future, I plan to introduce legislation to amend the Liquor Code. My legislation would allow for the direct shipment of wine to residents of the Commonwealth.

The legislation would require any entity that wishes to ship wine into the Commonwealth file a written application with the PLCB for a direct wine shipper’s permit. In addition, they would be required to obtain a sales tax license from the PA Department of Revenue.

It would not limit the amount of wine a direct wine shipper could ship to an individual in the Commonwealth; however, the direct wine shipper would have to report to the PLCB the name brand, bottle size and quantities shipped into the Commonwealth each month.

All wine shipped into the Commonwealth must be shipped through a transporter-for hire that is licensed by the PLCB. Licensing the delivery agent will enable the PLCB to require the signature of an individual over the age of 21 before any wine will be released.

The direct wine shipper must collect the 6% sales tax from any person to whom they are shipping wine in the Commonwealth. They must then remit this tax to the Department of Revenue on a quarterly basis.
