Subject: Restricting Certain Criminals from Appearing on the Ballot (former HB 2222)
 
In the near future, I will be re-introducing legislation – former House Bill 2222 – amending the Election Code to require all candidates, except for federal office, to certify that they have not been convicted of embezzlement of public moneys, bribery, perjury or any other infamous crime.

Article II, Section 7 of the Pennsylvania Constitution states that “no person hereafter convicted of embezzlement of public moneys, bribery, perjury or other infamous crime, shall be eligible to the General Assembly, or capable of holding any office of trust or profit in this Commonwealth.” However, candidates for office in Pennsylvania are not currently required to certify, when filing nomination petitions, that they have not been convicted of such infamous crimes. Consequently, candidates convicted of such offenses could be elected without proper disclosure. I believe this should be addressed in order to avoid any future conflicts.

My legislation amends the Pennsylvania Election Code by adding a provision requiring candidates for office to certify, via affidavit, that they have not been convicted of embezzlement of public moneys, bribery, perjury or any other infamous crime. By adding this provision to the Election Code, this legislation will ensure the honesty of candidates and the integrity of elections.
