MEMORANDUM

Posted: January 29, 2015 04:03 PM
From: Representative Thomas H. Killion
To: All House members
Subject: Transportation Network Companies (former HB 2445)

In the near future, I plan to reintroduce legislation regarding Transportation Network Companies (TNC). A TNC is a company that uses a digital network to connect passengers with the company’s drivers in order to provide transportation. You may have read or seen newspaper reports of TNCs with the appearance of Uber and Lyft in the Commonwealth. These digital platforms are being used by other PUC regulated common carriers as well.

My legislation would protect the consumer while promoting this new and innovative industry. Under my legislation the TNC would be required to:
  1. Obtain commercial liability insurance as primary coverage, rather than a secondary umbrella policy,
  2. Obtain a Certificate of Public Convenience,
  3. Obtain and file with the PUC criminal background checks on the network drivers,
  4. Obtain a special tag from PennDOT to provide easy identification for the passenger,
  5. Exempt service in a city of the First Class as the Philadelphia Parking Authority has separate jurisdiction.

By establishing certain minimal restrictions on TNCs the consumer will be adequately protected in the event of a traffic mishap; from unscrupulous drivers; or placing themselves in imminent danger due to an improperly inspected vehicle.

Please consider co-sponsoring this legislation. If you have questions, contact Alison in my office at ahagler@pahousegop.com.
