Subject: Civil Liability for Drug Dealers
 
In the near future I will be re-introducing legislation that would impose civil liability on persons who knowingly participate in the illegal drug market by providing for the recovery of damages by certain persons and establishing the procedures for bringing a private action to recover damages. It is time for those who engage in illegal drug activity to bear the cost of their crimes.

This legislation will provide another means of deterrence for illegal drug activity while holding those who engage in illegal drug activity responsible for the costs of their crimes to individuals, businesses and institutions who presently bear these costs.

An illegal drug market is defined as the support system of illegal drug-related operations, from production to retail sales, through which an illegal drug reaches an individual drug user.

Persons who may bring a private action for civil damages caused by an illegal drug by an individual drug used due to a person knowingly participating in the illegal drug market include a parent, legal guardian, child, spouse or sibling or an employer of an individual drug user. Additionally a medical facility, insurer, government entity employer or other entity that funds a drug treatment program or employee assistance program for an individual drug user may also bring a private action for civil action to recover funding not paid for by the individual drug user.
