Subject: Power of Attorney Legislation
 
In the near future, I will be introducing legislation recommended by the Joint State Government Commission regarding the investigation of fraud and mismanagement on the part of an agent appointed under a power of attorney.

The commission published its recommendations in its June 2010 report, which included language to empower a court to order an investigation, appoint a guardian ad litem, make a referral to an appropriate government agency or take other action to address allegations that a principal is suffering from financial abuse or mismanagement by an agent appointed by the principal under a power of attorney.
