| Subject: | Corrections Officer Investigatory Procedures Act (Former House Bill 976) |
| In the near future I will be re-introducing legislation to create the Corrections Officer Investigatory Procedures Act (HB 976 of the 2013-14 legislative session, introduced by Representative Mike Fleck). This legislation will ensure that Pennsylvania’s Corrections Officers will maintain due process rights and afford them the ability to appeal during disciplinary proceedings. The Corrections Officers Investigatory Procedures Act is being introduced because of several, widespread instances where Corrections Officers were suspended without pay or benefits, at times for over a year, based on the accusations of inmates. These officers did not have the ability to question why they were being suspended or to defend themselves. This legislation, which is based on laws enacted in other states, would assure that Corrections Officers are afforded due process whenever accusations are made against them by inmates. I strongly believe, as does the leadership of the Pennsylvania State Corrections Officers Association, that any Corrections Officer found guilty of a crime should be removed from duty and prosecuted to the full extent of the law. This legislation simply guarantee the preservation of constitutional rights for our Corrections Officers. Please join me in co-sponsoring this important piece of legislation.
