Subject: Limitation on Interscholastic Athletics Disclosure Requirements
 

In the near future, I plan to introduce legislation that, if enacted, will amend the Public School Code of 1949 to limit the current interscholastic athletics disclosure requirements imposed on public schools pursuant to Article XVI-C of the Public School Code.
Article XVI-C of the Public School Code, entitled “Disclosure of Interscholastic Athletics Opportunities,” imposes annual reporting requirements on all school districts, vocational-technical schools and charter schools that provide interscholastic athletic opportunities for secondary school students. Under Article XVI-C, public schools must report to the Department of Education detailed data regarding the following:
  • Total number of students (broken down by gender and by race or ethnicity);
  • Varsity, junior varsity and freshman teams competing (broken down by gender); and
  • For each team listed, detailed information regarding the following:
    • Total number of team participants (broken down by gender);
    • Total number of male participants (broken down by race or ethnicity);
    • Total number of female participants (broken down by race or ethnicity);
    • The year each team was established, reestablished, eliminated or demoted from interscholastic competition;
    • The seasons each team completed;
    • Total value of contributions and purchases by booster clubs, alumni and other non-school sources;
    • Expenditures for travel, uniforms, equipment and supplies and facilities; and
    • The number of coaches and athletic trainers for each team and their compensation.
The first reports required under Article XVI-C will be due on October 15 of this year.


Article XVI-C entails a time-consuming and burdensome unfunded mandate on our public schools. I encourage my colleagues to review the Disclosure of Interscholastic Athletics Opportunities instructions and disclosure form, which can be found at: http://www.education.state.pa.us/portal/server.pt/gateway/PTARGS_6_2_152474_9153_1419362_43/. To reduce this burden, my bill will limit the reporting requirements of Article XVI-C by:
  • Limiting the reporting requirements to data for the immediately preceding year;
  • Eliminating the historical reporting requirement with respect to the year of establishment, reestablishment, elimination or demotion of each sponsored team;
  • Eliminating the requirement that public schools report on the value of contributions and purchases made by booster clubs, alumni and other non-school sources; and
  • Imposing a three-year sunset on Article XVI-C, so that the reporting requirements will expire on June 30, 2016.
Our public schools have been asked to reduce spending and improve administrative efficiencies. The General Assembly can help public schools in this regard by reducing reporting requirements that do not directly pertain to the education of children.
