AN ACT
Amending Title 64 (Public Authorities and Quasi-Public
Corporations) of the Pennsylvania Consolidated Statutes, in
Pennsylvania Broadband Development Authority, further
providing for definitions and for specific powers and duties.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 6102 of Title 64 of the Pennsylvania
Consolidated Statutes is amended by adding a definition to read:
§ 6102. Definitions.
The following words and phrases when used in this chapter
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:

"Broadband." As defined in 66 Pa.C.S. § 3012 (relating to
definitions).

Section 2. Section 6122 of Title 64 is amended by adding a
subsection to read:
§ 6122. Specific powers and duties.

(h) Authorization of contracts.--In accordance with the
broadband plan established under subsection (g), and in
cooperation with Commonwealth agencies under subsection (c), the
department, through the authority, shall, in collaboration with
the Department of General Services, authorize contracts to
advance broadband buildout and facilitate broadband services
utilizing Commonwealth real estate or telecommunications or
similar infrastructure assets. No other Commonwealth agency
shall enter into a contract to provide, facilitate or permit
third parties to provide broadband services of any kind with
Commonwealth assets or impair, frustrate or preclude the
department or the Department of General Services from
facilitating and authorizing contracts to advance broadband
buildout and services utilizing Commonwealth assets.
Section 3. This act shall take effect in 60 days.
