AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in general powers and
duties of the Department of Public Welfare, providing for
discontinuance of prudent payment.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 13, 1967 (P.L.31, No.21), known
as the Human Services Code, is amended by adding a section to
read:
Section 217. Discontinuance of Prudent Payment.--(a)
Beginning on the effective date of this section, the department
shall discontinue the practice of prudent payment for claims
submitted by Office of Developmental Programs providers. Nothing
in this section shall affect the department from implementing
other provisions of 42 CFR 447.45 (relating to timely claims
payment).
(b) As used in this section, the following words and phrases
shall have the following meanings:
"Clean claim" shall have the same meaning as the term does in

section 1111.2(f) of the act of May 17, 1921 (P.L.682, No.284),
known as The Insurance Company Law of 1921.
"Prudent payment" shall mean the practice of paying clean
claims within thirty days of receipt, but not sooner, by holding
the claim up to twenty-one days from receipt before processing
the claims through the weekly financial cycle.
Section 2. This act shall take effect immediately.
