AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in terms and courses of study,
further providing for minimum number of school days.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1501.9 of the act of March 10, 1949
(P.L.30, No.14), known as the Public School Code of 1949, added
June 5, 2020 (P.L.223, No.30), is amended to read:
Section 1501.9. Minimum Number of School Days During
Disaster Emergencies.--[Beginning in the 2020-2021 school year,
the minimum number of school days under section 1501 shall apply
notwithstanding any order] During any school year in which an
order is issued under a declaration of disaster emergency under
35 Pa.C.S. ยง 7301(c) (relating to general authority of Governor)
[.]:
(1) A school district may submit to the department a request
to be exempt from the minimum number of school days under

section 1501, and the Secretary of Education shall approve the
request if reasonably satisfied that the school district is
making or has made a bona fide effort to provide the minimum
number of days under section 1501.
(2) Any day in which the schools of a school district are
physically closed but instruction for pupils is conducted
virtually may be counted toward satisfying the minimum number of
school days under section 1501.
Section 2. This act shall take effect immediately.
