AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in terms and courses of study,
providing for extended school year services.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1501.9. Extended School Year Services.--(a) Each
student with an IEP shall be deemed eligible for extended school
year services during the summer of 2020. The following shall
apply:
(1) Each school district shall notify, as appropriate,
parents and students of the right to participate in extended
school year services and shall provide information as to the
instructional options available.

(2) Nothing in this section shall be construed to equate
extended school year services to compensatory education.
(b) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Compensatory education." Supplementary programs or services
designed for students when a school district does not provide a
free and appropriate public education for students.
"Extended school year services." As defined in 34 CFR
300.106(b) (relating to extended school year services).
"IEP." An in dividualized education program as established in
accordance with 22 Pa. Code ยง 14.131 (relating to IEP).
Section 2. This act shall take effect immediately.
