AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in firearms and other dangerous
articles, providing for liability insurance for firearms.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 6128. Liability insurance for firearms.
(a) General rule.--A person who owns a firearm shall obtain
and continuously maintain a policy of liability insurance in an
amount not less than $100,000 specifically covering any damages
that result from any acts involving the use of the firearm while
the firearm is owned by the person.
(b) Current firearm owners.--Within 30 days of the effective
date of this subsection, a person who owns a firearm shall
obtain the liability insurance required under subsection (a).
(c) Loss or theft of firearm.--For purposes of this section,
a person shall be deemed to be the owner of a firearm if the
firearm is lost or stolen until such time as the loss or theft

is reported to the municipal police of the jurisdiction in which
the loss or theft is believed to have occurred or the
Pennsylvania State Police.
(d) Penalty.--A person who violates this section commits a
summary offense and shall, upon conviction, be sentenced to pay
a fine not exceeding $300 or to imprisonment for not more than
90 days.
(e) Applicability.--This section does not apply to a law
enforcement officer authorized to carry a firearm.
Section 2. This act shall take effect in 60 days.
