AS AMENDED ON THIRD CONSIDERATION, JUNE 11, 2018
AN ACT
Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
"An act concerning elections, including general, municipal,
special and primary elections, the nomination of candidates,
primary and election expenses and election contests; creating
and defining membership of county boards of elections;
imposing duties upon the Secretary of the Commonwealth,
courts, county boards of elections, county commissioners;
imposing penalties for violation of the act, and codifying,
revising and consolidating the laws relating thereto; and
repealing certain acts and parts of acts relating to
elections," in nomination of candidates, further providing
for number of signers required for nomination petitions of
candidates at primaries.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 912.1(32) of the act of June 3, 1937
(P.L.1333, No.320), known as the Pennsylvania Election Code, is
amended to read:
Section 912.1. Number of Signers Required for Nomination
Petitions of Candidates at Primaries.--Candidates for nomination
of offices as listed below shall present a nominating petition
containing at least as many valid signatures of registered and

enrolled members of the proper party as listed below:

(32) [Office of district justice: One hundred.] Office of
magisterial district judge: One hundred, but only for a
candidate's primary election when the candidate does not already
hold the office of magisterial district judge. A sitting
magisterial district judge elected to the office shall not be
required to file a nominating petition under this section to run
for the office of magisterial district judge but may instead
file a certificate of nomination for reelection specifying the
intent to seek reelection to the office. IF A SITTING
MAGISTERIAL DISTRICT JUDGE FILES A CERTIFICATE OF NOMINATION FOR
REELECTION, THE SITTING MAGISTERIAL DISTRICT JUDGE MAY NOT
CHALLENGE THE NOMINATING PETITION OF ANOTHER CANDIDATE FOR
MAGISTERIAL DISTRICT JUDGE.

Section 2. This act shall take effect in 60 days.
