AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in safe schools, providing for mental
health treatment of students.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1310.1-A. Mental Health Treatment of Students.--
Whenever a chief administrator recommends that a parent,
guardian or individual standing in loco parentis of a student
provide the student with access to treatment under the act of
July 9, 1976 (P.L.817, No.143), known as the "Mental Health
Procedures Act," the student may not enter a school entity until
the chief administrator or chief administrator's designee
obtains notice from an appropriate mental health professional
that the student received the treatment. The chief

administrator's designee under this section shall remain fixed
throughout the school year.
Section 2. This act shall take effect in 60 days.
