AN ACT
Amending the act of June 27, 2006 (1st Sp.Sess., P.L.1873,
No.1), entitled "An act providing for taxation by school
districts, for the State funds formula, for tax relief in
first class cities, for school district choice and voter
participation, for other school district options and for a
task force on school cost reduction; making an appropriation;
prohibiting prior authorized taxation; providing for
installment payment of taxes; restricting the power of
certain school districts to levy, assess and collect taxes;
and making related repeals," in taxation by school districts,
further providing for public referendum requirements for
increasing certain taxes.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 333(f) of the act of June 27, 2006 (1st
Sp.Sess., P.L.1873, No.1), known as the Taxpayer Relief Act, is
amended by adding a paragraph to read:
Section 333. Public referendum requirements for increasing
certain taxes.

(f) Referendum exceptions.--A school district may, without
seeking voter approval under subsection (c), increase the rate

of a tax levied for the support of the public schools by more
than the index if all of the following apply:

(3) A school district proceeding under the provisions of
this subsection shall hold two public hearings on the subject
of its intent to increase the rate of tax levied as proposed
in this subsection and subsection (n). At least one week
prior to the public hearings, the school district shall
publish notice of the hearings in a newspaper of general
circulation in the school district and on the school
district's publicly accessible Internet website, if one is
maintained. The notice shall include the purpose, date, time
and place of the public meetings. Each public meeting shall
be held on a weekday during an academic school week as
follows:
(i) one public meeting shall be held between the
hours of 9 a.m. and 3:30 p.m.; and
(ii) one public meeting shall be held between the
hours of 3:30 p.m. and 10 p.m.

Section 2. This act shall take effect in 60 days.
