AN ACT
Amending Titles 35 (Health and Safety) and 74 (Transportation)
of the Pennsylvania Consolidated Statutes, in grants to fire
companies and emergency medical services companies,
establishing the Voluntary Fire Company Physical Improvement
Program and Volunteer Fire Company Physical Improvement Fund;
and, in sustainable mobility options, further providing for
Public Transportation Trust Fund.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Chapter 78 of Title 35 of the Pennsylvania
Consolidated Statutes is amended by adding a subchapter to read:

§ 7815. Definitions.

The following words and phrases when used in this subchapter
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Department." The Department of Community and Economic
Development.
"Fund." The Volunteer Fire Company Physical Improvement
Fund.
"Program." The Voluntary Fire Company Physical Improvement
Program.
§ 7816. Establishment.
The Volunteer Fire Company Physical Improvement Program is
established and shall be administered by the department. Grants
provided under this program shall be used to provide funding for
physical structure and items needed to create living quarters.
§ 7817. Award of grants.
(a) Authorization.--The department may award a grant to an
eligible volunteer fire company for the construction or
renovation of the volunteer fire company's facility or the
purchase or repair of fixtures and furnishings necessary to
create living quarters for firefighters to live on the premises
of the volunteer fire company.
(b) Application process.--The following apply:
(1) A volunteer fire company seeking a grant under the
program shall submit a completed application during the
application period to the department on a form specified by
the department.
(2) The application period shall remain open for 45 days
each year.
(3) The department shall approve or disapprove an
application within 60 days after the close of the application

period.
(4) An application which has not been approved or
disapproved by the department within 60 days after the close
of the application period shall be deemed approved.
(c) Eligibility.--A volunteer fire company shall be
ineligible to receive a grant under the program if the volunteer
fire company provided living quarters for volunteer firefighters
in the two years prior to the date when the department received
the volunteer fire company's application under subsection (b).
(d) Company duties.--No later than one year from the date a
grant under the program is awarded to a volunteer fire company,
the volunteer fire company shall recruit individuals to be
volunteer firefighters by providing the individuals with living
quarters on the volunteer fire company's premises in exchange
for fire coverage service.
§ 7818. Volunteer Fire Company Physical Improvement Fund.
(a) Establishment.--There is established within the State
Treasury a special fund to be known as the Volunteer Fire
Company Physical Improvement Fund.
(b) Deposits.--The following shall be deposited into the
fund:
(1) 0.1% of the amount collected under Article II of the
act of March 4, 1971 (P.L.6, No.2), known as the Tax Reform
Code of 1971. Revenues under this paragraph shall be
deposited into the fund by the 20th day of each month for the
preceding month.
(2) Transfers or appropriations into the fund.
(c) Appropriation.--Amounts in the fund are appropriated on
a continuing basis to the department for the purpose of
administering this subchapter.

Section 2. Section 1506(c)(1) of Title 74 is amended to
read:
§ 1506. Fund.
* * *
(c) Other deposits.--The following shall be deposited into
the fund annually:
(1) [4.4%] 4.3% of the amount collected under Article II
of the Tax Reform Code. Revenues under this paragraph shall
be deposited into the fund by the 20th day of each month for
the preceding month. The amount deposited under this
paragraph is estimated to be equivalent to the money
available to the department from the following sources:
(i) The Supplemental Public Transportation Account
established under former section 1310.1 (relating to
supplemental public transportation assistance funding).
(ii) The amount appropriated annually by the
Commonwealth from the General Fund for mass transit
programs pursuant to a General Appropriations Act.

Section 3. This act shall take effect in 60 days.
