AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in rules of the road in general, further providing
for restrictions on use of limited access highways, providing
for commuter lanes program and imposing penalties.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3313(d) of Title 75 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
§ 3313. Restrictions on use of limited access highways.

(d) Driving in right lane.--
* * *
(1.1) No driver shall continuously drive in the left
lane of a limited access highway so as to impede the flow of
other traffic.

Section 2. Title 75 is amended by adding a section to read:
§ 3313.1. Commuter lanes program.
(a) Commuter lanes zones.--The department may establish

commuter lanes zones in areas of high congestion on a highway.
Commuter lanes zones under this section shall be no less than
seven miles in length.
(b) Municipal government request.--A municipal government
may petition the department to establish a commuter lanes zone
on a State route within its municipal limits. The department
shall evaluate the request and may authorize the commuter lanes
zone by an agreement with the municipal government. The
agreement shall assign costs of implementation, including
signage.
(c) Traffic control devices.--Official traffic control
devices shall be placed along the commuter lanes zone to notify
motorists that increased penalties apply for a violation under
subsection (d).
(d) Summary offense.--A driver of a vehicle with more than
two axles that violates commuter lanes zone restrictions commits
a summary offense and shall, upon conviction, be sentenced to
pay a fine of $100.
(e) Definition.--For purposes of this section, the term
"commuter lanes zone" means a portion of a highway in which
vehicles with more than two axles are limited or restricted from
particular travel lanes.
Section 3. This act shall take effect in 60 days.
