AN ACT
Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
Statutes, in food protection, further providing for
misbranding of food.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 5729(a)(10) of Title 3 of the
Pennsylvania Consolidated Statutes is amended to read:
ยง 5729. Misbranding of food.
(a) General rule.--A food shall be misbranded:

(10) If it is a raw agricultural commodity bearing or
containing a pesticide chemical applied after harvest, unless
the shipping container of the commodity bears labeling which
clearly and conspicuously declares the presence of the
chemical and the common or usual name and function of the
chemical. A clear and conspicuous declaration shall [not] be
required when the commodity is removed from the shipping
container and is held or displayed for sale at retail [in

accordance with the custom of the trade].

Section 2. This act shall take effect in 270 days.
