AN ACT
Providing for requirements relating to administration of
obstetrical ultrasound procedures.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Obstetrical
Ultrasound Procedure Limitations Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Department." The Department of Health of the Commonwealth.
"Health care practitioner." An individual who holds a valid
license to practice a component of the healing arts issued by
the State Board of Medicine, the State Board of Osteopathic
Medicine or the State Board of Nursing.
Section 3. Restrictions.
(a) Order for ultrasound.--Only a health practitioner,

acting within the practitioner's authorized scope of practice,
may issue an order for the administration of an ultrasound
procedure upon a pregnant woman.
(b) Performance of ultrasound procedure.--No person shall
perform an ultrasound procedure upon a pregnant woman unless the
procedure meets the following criteria:
(1) Is ordered by a health care practitioner.
(2) Serves a medical or diagnostic purpose.
Section 4. Violations.
The department shall cause an investigation to be instituted
of any alleged violation of this act. Whenever the department
has reasonable cause to believe that a person has violated any
provision of this act, the department shall issue and serve upon
the person a notice to cease and desist from the violation.
Section 5. Regulations.
The department shall promulgate regulations to administer and
enforce this act.
Section 6. Effective date.
This act shall take effect in 60 days.
