AN ACT
Amending Title 74 (Transportation) of the Pennsylvania
Consolidated Statutes, in organization, further providing for
deputy secretaries; and making related repeals.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 202(a) of Title 74 of the Pennsylvania
Consolidated Statutes is amended and the section is amended by
adding subsections to read:
§ 202. Deputy secretaries.
(a) Appointment.--The secretary shall appoint the following
deputy secretaries:
(1) Deputy Secretary for Administration.
(2) Deputy Secretary for Driver and Vehicle Services.
(3) Deputy Secretary for Highway Administration.
(4) Deputy Secretary for Multimodal Transportation.
(5) Deputy Secretary for Planning.
(6) Executive Deputy Secretary.

(g) Executive Deputy Secretary.--The Executive Deputy
Secretary has the powers and duties of the department under law
and shall exercise the power of the secretary if the secretary
is unable to perform his or her duties.
(h) Designations.--Notwithstanding any other provision of
law, the secretary may designate the executive deputy secretary
or any of the deputy secretaries to act in the secretary's
place.
Section 2. Repeals are as follows:
(1) Section 2001.3 of the act of April 9, 1929 (P.L.177,
No.175), known as The Administrative Code of 1929, is
repealed.
(2) Section 4 of the act of May 21, 1937 (P.L.774,
No.211), referred to as the Pennsylvania Turnpike Commission
Act, is repealed insofar as it is inconsistent with the
addition of 74 Pa.C.S. § 202(g).
Section 3. This act shall take effect in 60 days.
