AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in forgery and fraudulent practices,
providing for the offense of misrepresentation as service
animal.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 4121. Misrepresentation as service animal.
(a) Offense defined.--A person commits the offense of
misrepresentation as service animal if the person knowingly:
(1) creates a document that misrepresents an animal as a
service animal;
(2) provides to another person documents falsely stating
that an animal is a service animal;
(3) fits an animal, when the animal is not a service
animal, with a harness, collar, vest or sign of the type
commonly used by a person with a disability to indicate an
animal is a service animal; or

(4) represents that an animal is a service animal when
the animal has not completed training to perform disability-
related tasks or disability-related work for a person with a
disability.
(b) Grading.--A person who violates subsection (a) commits a
summary offense and shall, upon conviction, be sentenced to pay
a fine in an amount not to exceed $1,000.
(c) Definition.--As used in this section, "service animal"
means a guide, signal or service dog or other aid animal that
has been certified by a recognized authority to assist a person
with a disability.
Section 2. This act shall take effect in 60 days.
