AN ACT
Amending the act of November 10, 1999 (P.L.491, No.45), entitled
"An act establishing a uniform construction code; imposing
powers and duties on municipalities and the Department of
Labor and Industry; providing for enforcement; imposing
penalties; and making repeals," in exemptions, applicability
and penalties, further providing for exemptions.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 901(h)(2)(iv) of the act of November 10,
1999 (P.L.491, No.45), known as the Pennsylvania Construction
Code Act, is amended to read:
Section 901. Exemptions.

(h) Fire protection of floors.--

(2) Paragraph (1) shall not apply to any of the
following:

(iv) A wood floor assembly using dimension lumber or
structural composite lumber equal to or greater than two-

inch by ten-inch nominal dimension or a floor assembly
approved by a [municipal code official] professional
engineer licensed in this Commonwealth demonstrating
equivalent fire performance.

Section 2. This act shall take effect in 60 days.
