AN ACT
Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
"An act concerning elections, including general, municipal,
special and primary elections, the nomination of candidates,
primary and election expenses and election contests; creating
and defining membership of county boards of elections;
imposing duties upon the Secretary of the Commonwealth,
courts, county boards of elections, county commissioners;
imposing penalties for violation of the act, and codifying,
revising and consolidating the laws relating thereto; and
repealing certain acts and parts of acts relating to
elections," in nomination of candidates, providing for
disclosure of Federal tax returns by candidates for office of
President of the United States.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 3, 1937 (P.L.1333, No.320), known
as the Pennsylvania Election Code, is amended by adding a
section to read:
Section 914.1. Disclosure of Federal Tax Returns By
Candidates for Office of President of the United States.--(a) A
candidate for the office of President of the United States shall
not be permitted to cast lots for the position of the

candidate's name upon the primary ballots or ballot labels or be
certified by the Secretary of the Commonwealth to appear on the
official primary ballots or ballot labels unless the candidate
has submitted the following to the Secretary of the
Commonwealth:
(1) A certified and complete copy of the candidate's Federal
income tax returns for the five most recent available years.
(2) A written consent for public disclosure of the Federal
income tax returns.
(b) The Secretary of the Commonwealth shall post the Federal
income tax returns of a candidate for the office of President of
the United States who has given written consent for public
disclosure of the Federal income tax returns under subsection
(a) on the publicly accessible Internet website of the Bureau of
Commissions, Elections and Legislation of the Department of
State no later than 30 days prior to the primary election.
(c) The name of a candidate for the office of President of
the United States may not appear on an official primary ballot
or ballot label unless the candidate has complied with the
provisions of this section.
Section 2. This act shall take effect in 60 days.
