AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in governance of the
system, providing for problem-solving court fees.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 1725.8. Problem-solving court fees.
(a) Drug court fee.--
(1) A county that has established a drug court under
section 916 (relating to problem-solving courts) may adopt,
by local ordinance, a fee which shall be imposed upon a
person who:
(i) pleads guilty or nolo contendere to or who is
convicted of or receives Accelerated Rehabilitative
Disposition for a violation of the act of April 14, 1972
(P.L.233, No.64), known as The Controlled Substance,

Drug, Device and Cosmetic Act; or
(ii) is placed on probation without verdict under
section 17 of The Controlled Substance, Drug, Device and
Cosmetic Act.
(2) The fee shall be in addition to any other fines,
penalties or costs imposed by law.
(3) The amount of the fee may not exceed $250.
(4) The fee shall be paid to the county and deposited
into a special drug court fund established in the county.
Money in the special fund shall be used solely for the
establishment, administration and daily operation of the drug
court established under section 916.
(b) (Reserved).
Section 2. This act shall take effect in 60 days.
