AN ACT
Prohibiting certain individuals from providing support in the
implementation of certain sections of the National Defense
Authorization Act of 2012.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Liberty
Preservation Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Employee." An individual employed by any of the following:
(1) The Commonwealth.
(2) A political subdivision of the Commonwealth.
(3) A corporation providing services to the
Commonwealth.
This term shall include public officials and agents for any of
the above.

Section 3. Prohibition.
No employee shall provide material support or participate in
any way with the implementation of sections 1021 and 1022 of the
National Defense Authorization Act for Fiscal Year 2012 (Public
Law 112-81, 125 Stat. 1298) within the boundaries of this
Commonwealth.
Section 4. Duty of Attorney General to report certain activity.
The Attorney General shall report to the Governor and General
Assembly any attempt by agencies or agents of the Federal
Government to secure the implementation of sections 1021 and
1022 of the National Defense Authorization Act for Fiscal Year
2012 (Public Law 112-81, 125 Stat. 1298) through the operations
of the Federal Government, including any of its agencies,
departments, employees or agents, or through the operations of
the Commonwealth, a political subdivision of the Commonwealth or
a corporation providing services to the Commonwealth, including
any of their agencies, departments, employees or agents.
Section 5. Penalty.
Any employee who enforces or attempts to enforce an act,
order, law, statute, rule or regulation of the Federal
Government in violation of section 3 commits a misdemeanor and
shall, upon conviction, be sentenced to pay a fine of not more
than $500 or to imprisonment for not more than six months, or
both.
Section 6. Effective date.
This act shall take effect immediately.
