AN ACT
Amending Title 74 (Transportation) of the Pennsylvania
Consolidated Statutes, in turnpike, providing for tunnel
maintenance and inspection and further providing for
electronic toll collection; and, in Turnpike Commission
standards of conduct, further providing for qualifications,
restrictions and duties of commission members and employees.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 74 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 8107.1. Tunnel maintenance and inspection.
(a) Duties of commission.--The commission shall:
(1) On or before December 31, 2017, install video
cameras in tunnels that do not have video monitoring
capability.
(2) On or before December 31, 2017, install fire
detection and suppression systems in tunnels that do not have
such detection systems.
(3) Ensure that each tunnel undergoes a routine
inspection biennially in accordance with commission

guidelines and Federal Highway Administration regulations.
(4) Expand the development and deployment of a tunnel
management tracking system so that all tunnel inspection
recommendations and their implementation status are available
through the database.
(b) Tunnel Management Committee.--The commission's chief
operating officer shall convene a multidepartmental Tunnel
Management Committee, which shall include, at a minimum, the
departments of engineering, maintenance, facilities and energy
management and traffic engineering and operations for
information regarding tunnel inspection and safety issues. The
Tunnel Management Committee members shall select a chairperson
from among its members who shall serve as the single point of
contact for tunnel safety concerns.
Section 2. Section 8117 of Title 74 is amended by adding a
subsection to read:
§ 8117. Electronic toll collection.

(d.1) Customer service.--An entity that enters into a
contract with the commission to operate or maintain electronic
toll collection shall provide telephone access to the entity's
customer service center during normal business hours and extend
its hours of operation beyond normal business hours at least one
day a week.

Section 3. Section 8203(a)(3) of Title 74 is amended and the
section is amended by adding a subsection to read:
§ 8203. Qualifications, restrictions and duties of commission
members and employees.
(a) General rule.--The following qualifications and

restrictions shall apply to members and executive-level
employees:

(3) (i) No member or executive-level employee shall be
paid or receive any fee or other compensation other than
salary and actual and necessary traveling expenses
provided by law and as limited by commission policy for
any activity directly pertaining to the duties of the
commission. A member may be reimbursed for an expense
that exceeds commission limits only upon submission of:
(A) an adequate explanation or justification of
the appropriateness of the expense incurred; and
(B) a receipt documenting the expense incurred.
(ii) Any cellular device or other electronic
equipment for member use must be purchased through the
commission's purchasing office. A member who purchases a
cellular device or other electronic equipment is not
entitled to reimbursement for the device or equipment.
(iii) The commission shall post on its publicly
accessible Internet website monthly reports detailing
member expenses.
[(ii)] (iv) Nothing in this chapter shall be
construed to prohibit a member or executive-level
employee from engaging in any employment or vocation that
is not incompatible with service as a member or
executive-level employee.

(c) Travel on turnpike.--The following applies to toll-free
access to and travel on the turnpike:
(1) The commission may authorize toll-free access to and

travel on the turnpike:
(i) When access to and travel on the turnpike is
required by any of the following who are engaged in
employment-related activity and only for the duration of
the activity:
(A) Commission members and employees.
(B) Contractors, subcontractors, consultants and
subconsultants of the commission.
(C) Concessionaires.
(D) Authorized service providers.
(E) Emergency service responders.
(ii) When access to and travel on the turnpike is
required by government agencies and entities that are
conducting official commission business and only for the
duration of the conduct of the business.
(2) Toll-free access to and travel on the turnpike by
individuals for personal travel is prohibited.
(3) The commission shall:
(i) Monitor toll-free access to and travel on the
turnpike, including access and travel by persons not
employed by the commission, to ensure compliance with any
trust indenture.
(ii) Ensure its nonrevenue identification cards
include a photograph of the individual to whom the card
is issued.
(iii) Post on its publicly accessible Internet
website quarterly usage reports of toll-free turnpike
travel, including usage by persons listed under paragraph
(1).
Section 4. This act shall take effect in 60 days.
