AN ACT
Amending Title 4 (Amusements) of the Pennsylvania Consolidated
Statutes, in Pennsylvania Gaming Control Board, further
providing for applicability of other statutes, for general
and specific powers, for expenses of regulatory agencies and
for regulatory authority of board.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Sections 1201.1(b)(1) and 1202(b)(4) of Title 4
of the Pennsylvania Consolidated Statutes are amended to read:
§ 1201.1. Applicability of other statutes.

(b) Status of board.--
(1) The board shall be considered an independent agency
for the purposes of the following:
(i) 62 Pa.C.S. Pt. I (relating to Commonwealth
Procurement Code). The expediting of the payment of
revenue to the Commonwealth shall not be grounds for an
emergency procurement by the board. The board shall
prepare detailed, written justification with supporting

documentation for contracts entered into under 62 Pa.C.S.
§ 515 (relating to sole source procurement) or 516
(relating to emergency procurement). The justification
and supporting documentation shall be retained in
accordance with the Commonwealth's record retention
policy established by the Office of Administration.
(ii) The act of October 15, 1980 (P.L.950, No.164),
known as the Commonwealth Attorneys Act.

§ 1202. General and specific powers.

(b) Specific powers.--The board shall have the specific
power and duty:

(4) To contract and execute instruments as necessary to
carry out the powers and duties of the board. Contracts for
the purchase of supplies, services and construction shall be
for a term not to exceed two years[.], and for any contract
renewed, a detailed, written justification for the renewal
shall be prepared. The justification and supporting
documentation shall be retained in accordance with the
Commonwealth's record retention policy established by the
Office of Administration.

Section 2. Section 1202.2 of Title 4 is amended by adding a
subsection to read:
§ 1202.2. Expenses of regulatory agencies.

(c) Policy.--The board, in conjunction with the Office of
Attorney General and the Commissioner of the Pennsylvania State

Police, shall establish a policy governing expense
documentation. The policy shall:
(1) Clearly define allowable expenses and specify
expenses for which reimbursement is prohibited, including,
but not limited to, expenses for gifts and items such as
candy and flowers.
(2) Include procedures that ensure that individuals
seeking reimbursement submit receipts as required.
(3) Require the submission of written justification that
documents the necessity for any travel expense for which
reimbursement is sought.
(4) Disallow reimbursement for a lodging expense that
exceeds standard State limits unless acceptable written
justification is provided.
Section 3. Section 1207 of Title 4 is amended by adding a
paragraph to read:
§ 1207. Regulatory authority of board.
The board shall have the power and its duties shall be to:

(15.1) Adopt a written procurement policy by official
action of the board at a public meeting of the board.

Section 4. This act shall take effect in 60 days.
