AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in driving after imbibing alcohol or utilizing
drugs, providing for registry of habitual DUI offenders.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 75 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 3818. Registry of habitual DUI offenders.
(a) Establishment.--
(1) Not later than 90 days after the effective date of
this section, the department shall establish and maintain a
State registry to be known as the Pennsylvania Habitual DUI
Offenders Registry. The registry shall contain all of the
information specified in paragraph (3) regarding any person
who on or after the effective date of this section is
convicted in this Commonwealth for the fifth or subsequent
time in the preceding 20 years of a violation of section 3802
(relating to driving under influence of alcohol or controlled

substance) or 30 Pa.C.S. § 5502 (relating to operating
watercraft under influence of alcohol or controlled
substance).
(2) The registry shall be a public record subject to
inspection under the act of February 14, 2008 (P.L.6, No.3),
known as the Right-to-Know Law. The department shall obtain
the information to be included in the registry from the
reports provided by the court under subsection (b).
(3) The registry shall include at least the following
information regarding each offender:
(i) The offender's name, date of birth, residence
address and employment address, including, but not
limited to, the street address, municipal corporation or
township, county and zip code of the person's place of
residence.
(ii) The number of times within the preceding 20
years that the offender has been convicted in this
Commonwealth for a violation of section 3802 or 30
Pa.C.S. § 5502, the date of each of those convictions and
their respective locations.
(4) The department shall post the information from the
registry as a database on the department's publicly
accessible Internet website. The database shall be searchable
by an offender's name, county and zip code of residence.
(b) Duty of court.--A court that convicts a person for a
violation of section 3802 shall send to the department, within
30 days after the conviction of the offender, the information
specified in subsection (a)(3)(i).
(c) Monthly updating required.--The department shall update
the registry and the database on a monthly basis to ensure that

the information contained in the registry and database is
accurate and current.
Section 2. This act shall take effect in 60 days.
