AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, further providing for the offense of
robbery.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3701(b) of Title 18 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
§ 3701. Robbery.

(b) Grading.--

(3) (i) The Pennsylvania Commission on Sentencing,
under 42 Pa.C.S. § 2154 (relating to adoption of
guidelines for sentencing), shall provide for a
sentencing enhancement if during the commission of the
offense under this section or immediate flight therefrom,
the actor knowingly concealed or attempted to conceal all
or part of the actor's face in order to hide the actor's

identity from any individual.
(ii) The provisions of this paragraph shall not be
an element of the crime, and notice of the provisions of
this paragraph shall not be required prior to conviction.
Reasonable notice of the Commonwealth's intention to
proceed using the sentencing enhancement provided for
under this paragraph shall be provided after conviction
and before sentencing.
Section 2. This act shall take effect in 60 days.
