AN ACT
Amending the act of December 22, 2011 (P.L.586, No.127),
entitled "An act providing for gas and hazardous liquids
pipelines and for powers and duties of the Pennsylvania
Public Utility Commission; and imposing civil penalties,"
further providing for definitions; and providing for
recreational use and for storm water runoff.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 102 of the act of December 22, 2011
(P.L.586, No.127), known as the Gas and Hazardous Liquids
Pipelines Act, is amended by adding a definition to read:
Section 102. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:

"Public land." Land from any State park, State forest, State
game land, wildlife refuge, waterfowl refuge or municipal public
park.

Section 2. The act is amended by adding sections to read:
Section 702. Recreational use.
Within counties of the first, second and third class, if a
pipeline operator purchases or obtains an easement for public
land, agricultural-easement land or permanently preserved land
for new or expanded pipelines, the pipeline operator must
purchase or grant an easement for an equivalent section of land
within the respective county for public active or passive
recreational use. The recreational land shall be selected and
recreationally developed at the direction of the county. No
other development of the recreational land may occur.
Section 703. Storm water runoff.
(a) Duty of pipeline operators.--Notwithstanding any law or
regulation to the contrary, a pipeline operator engaged in the
construction or replacement of pipelines involving the
alteration or development of land shall ensure that the volume
and maximum rate of storm water runoff after the construction or
replacement does not exceed the volume and maximum rate of
runoff that existed prior to the construction or replacement.
(b) Duty of Department of Environmental Protection.--The
Department of Environmental Protection shall verify compliance
with this section through 25 Pa. Code Ch. 102 (relating to
erosion and sediment control) and may promulgate regulations to
implement this section.
Section 3. This act shall take effect in 60 days.
