AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in licensing of drivers, further providing for
3suspension of operating privilege.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1532(c) of Title 75 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 1532. Suspension of operating privilege.

10(c) Suspension.--The department shall suspend the operating
11privilege of any person upon receiving a certified record of the
12person's conviction of any offense involving the possession,
13sale, delivery, offering for sale, holding for sale or giving
14away of more than 30 grams of any controlled substance under the
15laws of the United States, this Commonwealth or any other state,
16or any person 21 years of age or younger upon receiving a
17certified record of the person's conviction or adjudication of
18delinquency under 18 Pa.C.S. § 2706 (relating to terroristic
19threats) committed on any school property, including any public

1school grounds, during any school-sponsored activity or on any
2conveyance providing transportation to a school entity or
3school-sponsored activity.

4(1) The period of suspension shall be as follows:

5(i) For a first offense, a period of six months from
6the date of the suspension.

7(ii) For a second offense, a period of one year from
8the date of the suspension.

9(iii) For a third and any subsequent offense
10thereafter, a period of two years from the date of the
11suspension.

12(2) For the purposes of this subsection, the term
13"conviction" shall include any conviction or adjudication of
14delinquency for any of the offenses listed in paragraph (1),
15whether in this Commonwealth or any other Federal or state
16court.

18Section 2. This act shall take effect in 60 days.
