AN ACT

 

1Amending Title 66 (Public Utilities) of the Pennsylvania
2Consolidated Statutes, in restructuring of electric utility
3industry, further providing for requirements for electric
4generation suppliers.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 2809 of Title 66 of the Pennsylvania
8Consolidated Statutes is amended by adding a subsection to read:

9§ 2809. Requirements for electric generation suppliers.

11(g) Customer contracts for electric generation supply
12service.--

13(1) A residential or small business customer may rescind
14at any time a contract for electric generation supply service
15at no cost to the customer if the contract is entered into as
16a result of a transaction that involved a supplier or its
17agent engaging in door-to-door sales or telemarketing as
18described in 52 Pa. Code Ch. 111 (relating to marketing and

1sales practices for the retail residential energy market).

2(2) As used in this section, the following words and
3phrases shall have the meanings given to them in this
4subsection:

5"Agent." A person who conducts marketing or sales
6activities, or both, on behalf of a licensed supplier. The
7term includes an employee, a representative, an independent
8contractor or a vendor. The term also includes a
9subcontractor, employee, vendor and representative not
10directly contracted by a supplier who conducts marketing or
11sales activities on behalf of the supplier.

12"Door-to-door sales." A solicitation or sales method by
13which an agent proceeds randomly or selectively from
14residence to residence.

15"Telemarketing." An activity, plan, program or campaign
16using one or more telephones that is conducted to induce
17customers to purchase goods or services.

18Section 2. This act shall take effect in 60 days.
