AN ACT

 

1Amending Title 51 (Military Affairs) of the Pennsylvania
2Consolidated Statutes, in educational assistance program,
3further providing for definitions and for amount of grants.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 3201 of Title 51 of the Pennsylvania
7Consolidated Statutes is amended by adding a definition to read:

8§ 3201. Definitions.

9The following words and phrases when used in this chapter
10shall have the meanings given to them in this section unless the
11context clearly indicates otherwise:

<-13"Costs of pursuing approved program of education." Tuition
14and fees, room and board and textbooks as long as such costs are
15documented by the approved institution of higher learning.

<-16"Costs of attendance." Allowable educational expenses, as 
17determined by the agency, that are consistent with the
 

1administration of the act of January 25, 1966 (1965 P.L.1546, 
2No.541), referred to as the Higher Education Scholarship Law.

4Section 2. Section 3205(c) of Title 51 is amended to read:

5§ 3205. Amount of grants.

7[(c) Other grants.--The agency shall not reduce the amount]

8(c) Other grants and financial aid.--

9(1) The agency shall not reduce the amount of other
10agency grants or aid for which the eligible member qualifies
11on account of the member's eligibility for or receipt of
12grants under this chapter.

13(2) Prior to making a grant under this chapter, the
<-14agency approved institution of higher learning shall first
15consider any Federal tuition assistance received by the
16eligible member and then shall award a grant under this
17chapter if the eligible member requires additional financial
18aid to cover <-documented costs of pursuing the costs of
19attendance for an approved program of <-higher education. A
20grant under this chapter shall <-not be paid or refunded to the
21eligible member for <-use for other than the costs of pursuing
22an approved program of education. Excess grants shall be
23refunded by the approved institution of higher learning to
24the agency for deposit in the fund. <-approved costs of
25attendance. Grants authorized under this section shall be
26reduced so that the total of all Federal and State military
27education benefits, as administered by the Pennsylvania
28National Guard, do not exceed 100% of the costs of
29attendance.
