AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in preliminary provisions, further
6providing for Keystone Exams; and, in State Board of
7Education, further providing for <-reports and recommendations 
<-8powers and duties of the board.

9The General Assembly of the Commonwealth of Pennsylvania
10hereby enacts as follows:

11Section 1. Section 121 of the act of March 10, 1949 (P.L.30,
12No.14), known as the Public School Code of 1949, added June 30,
132012 (P.L.684, No.82), is amended to read:

14Section 121. Keystone Exams.--(a) Subject to annual
15appropriation, not later than the 2020-2021 school year, the
16Department of Education shall develop and implement Keystone
17Exams in the following subjects: algebra I, literature, biology,
18English composition, algebra II, geometry, United States
19history, chemistry, civics and government and world history. The
20State Board of Education shall promulgate regulations, subject

1to the act of June 25, 1982 (P.L.633, No.181), known as the
2"Regulatory Review Act," necessary to implement this section.

3(b) In addition to any requirements on the State Board of
4Education under the "Regulatory Review Act", on the same date
5that pursuant to the "Regulatory Review Act" the State Board of
6Education submits a proposed regulation for or related to the
7implementation of Keystone Exams under this section to the
8Legislative Reference Bureau for publication of notice of
9proposed rulemaking in the Pennsylvania Bulletin as required by
10the act of July 31, 1968 (P.L.769, No.240), referred to as the
11Commonwealth Documents Law, and thereafter on the same date it
12submits the text of the final-form regulation to the Independent
13Regulatory Review Commission, it shall submit to the chairman
14and minority chairman of the Education Committee of the Senate
15and the chairman and minority chairman of the Education
16Committee of the House of Representatives a detailed fiscal
17impact statement that the proposed or final-form regulation will
18have on the Commonwealth, the communities, the school districts
19and, if applicable, private and private religious schools. The
20detailed fiscal impact statement shall include a comprehensive
21fiscal note of all direct and indirect costs whether incurred in
22preparation of the proposed or final-form regulation or which
23will be required as a result of the promulgation of the
24regulation to its best dollar estimate. The State Board of
25Education may include narrative statements to accompany its best
26dollar estimate, but may not do so in lieu of detailed best
27estimated dollar amounts.

<-28Section 2. Section 2605-B of the act is amended by adding a
29subsection to read:

30Section 2605-B. Reports and recommendations.--* * *

1(c) Anytime the board submits to the Independent Regulatory
2Review Commission a proposed or final-form regulation for
3processing under the act of June 25, 1982 (P.L.633, No.181),
4known as the "Regulatory Review Act", the board shall submit to
5the chairman and minority chairman of the Education Committee of
6the Senate and the chairman and minority chairman of the
7Education Committee of the House of Representatives on the same
8date a detailed fiscal impact statement that the proposed or
9final-form regulation will have on the Commonwealth, the
10communities, the school districts and, if applicable, private
11and private religious schools. The detailed fiscal impact
12statement shall include a comprehensive fiscal note of all
13direct and indirect costs whether incurred in preparation of the
14proposed or final-form regulation or which will be required as a
15result of the promulgation of the regulation to its best dollar
16estimate. The board may include narrative statements to
17accompany its best dollar estimate, but may not do so in lieu of
18detailed best estimated dollar amounts.

<-19Section 2. Section 2603-B of the act is amended by adding a
20subsection to read:

21Section 2603-B. Powers and Duties of the Board.--* * *

22(l) Notwithstanding any other provision of law to the 
23contrary, the board shall require that each regulation prepared 
24by the Council of Basic Education or the Council of Higher 
25Education under section 2604-B and promulgated by the board 
26under the act of June 25, 1982 (P.L.633, No.181), known as the 
27"Regulatory Review Act," includes, in so far as the regulation 
28relates to costs to the Commonwealth, the fiscal note prepared 
29by the Office of the Budget pursuant to section 612 of the act 
30of April 9, 1929 (P.L.177, No.175), known as "The Administrative
 

1Code of 1929."

2Section 3. This act shall take effect in 60 days.
