1Amending Title 26 (Eminent Domain) of the Pennsylvania
2Consolidated Statutes, further providing for limited
3reimbursement of appraisal, attorney and engineering fees.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 710(a) of Title 26 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 710. Limited reimbursement of appraisal, attorney and
9engineering fees.

10(a) General rule.--The owner of any right, title or interest
11in real property acquired or injured by an acquiring agency, who
12is not eligible for reimbursement of fees under section 306(g)
13(relating to preliminary objections), 308(d) (relating to
14revocation of condemnation proceedings) or 709 (relating to
15condemnee's costs where no declaration of taking filed), shall
16be reimbursed in an amount not to exceed $4,000 per property as
17a payment toward reasonable expenses actually incurred for
18appraisal, attorney and engineering fees, except where the
 

1taking is for an easement related to underground piping for 
2water or sewer infrastructure, in which case the reimbursement 
3is limited to $1,000.

5Section 2. This act shall take effect in 60 days.
