AN ACT

 

1Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
2"An act concerning townships of the first class; amending,
3revising, consolidating, and changing the law relating
4thereto," further providing for legal advertising.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 110 of the act of June 24, 1931
8(P.L.1206, No.331), known as The First Class Township Code,
9reenacted and amended May 27, 1949 (P.L.1955, No.569), is
10amended to read:

11Section 110. Legal Advertising.--Whenever, under the 
12provisions of this act, notice is required to be published in 
13one newspaper, such publication shall be made in a newspaper of 
14general circulation, as defined [by the Newspaper Advertising 
15Act, approved May sixteenth, one thousand nine hundred and 
16twenty-nine (Pamphlet Laws, one thousand seven hundred eighty-
17four), printed in the township, if there is such a newspaper, 
18and, if not, then in a newspaper circulating generally in such 
19township] in 45 Pa.C.S. § 101 (relating to definitions) which is
 

1circulated in the township affected. If such notice is required 
2to be published in more than one newspaper, it shall be 
3published in at least one newspaper of general circulation, 
4defined [as aforesaid, printed, if there be such a newspaper, or 
5circulating generally as above provided in the township] in 45 
6Pa.C.S. § 101 which is circulated in the township affected. When 
7such notice relates to any proceeding or matter in any court, or 
8the holding of an election for the increase of indebtedness, or 
9the issue and sale of bonds to be paid by taxation, such notice 
10shall also, in counties of the second, third, fourth and fifth 
11classes, be published in the legal newspaper, if any, designated 
12by the rules of court of the proper county for the publication 
13of legal notices and advertisements, unless such publication be 
14dispensed with by special order of court: Provided, however, 
15That ordinances, auditors' statements, summaries of auditors' 
16statements, advertisements inviting proposals for public 
17contracts and for bids for materials and supplies, or lists of 
18delinquent taxpayers, shall be published only in newspapers of 
19general circulation, defined as aforesaid.

20Section 2. This act shall take effect in 60 days.
