AN ACT

 

1Prohibiting certain individuals from providing support in the
2implementation of certain sections of the National Defense
3Authorization Act of 2012.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Short title.

7This act shall be known and may be cited as the Liberty
8Preservation Act.

9Section 2. Definitions.

10The following words and phrases when used in this act shall
11have the meanings given to them in this section unless the
12context clearly indicates otherwise:

13"Employee." An individual employed by any of the following:

14(1) The Commonwealth.

15(2) A political subdivision of the Commonwealth.

16(3) A corporation providing services to the
17Commonwealth.

18This term shall include public officials and agents for any of
19the above.

1Section 3. Prohibition.

2No employee shall provide material support or participate in
3any way with the implementation of sections 1021 and 1022 of the
4National Defense Authorization Act for Fiscal Year 2012, as
5amended, (Public Law 112-81, 125 Stat. 1298) within the
6boundaries of this Commonwealth. The Attorney General is
7directed to report to the Governor and General Assembly any
8attempt by agencies or agents of the United States Federal
9Government to secure the implementation of sections 1021 and
101022 of the National Defense Authorization Act, as amended, for
11Fiscal Year 2012 through the operations of the United States
12Federal Government, including any of its agencies, departments,
13employees or agents, or through the operations of the
14Commonwealth, a political subdivision of the Commonwealth or a
15corporation providing services to the Commonwealth, including
16any of their agencies, departments, employees or agents.

17Section 4. Penalty.

18Any employee who enforces or attempts to enforce an act,
19order, law, statute, rule or regulations of the government of
20the United states in violation of section 3 commits a
21misdemeanor and shall, upon conviction, be sentenced to pay a
22fine of not more than $500, or to imprisonment for not more than
23six months, or both.

24Section 5. Effective date.

25This act shall take effect immediately.
